Terms, Conditions and Policies

 

Definitions

“The Company” means AB Lab Mart.
“The customer” and/or “the customers” means the customer of the company.
“The order” means any sales order, local order, purchase order, local purchase order, and any contract for the sales of goods by the company to the customer.
“The goods” and/or “the product” and/or “the products” means goods of any description stated in the order including parts, components, and ingredients of any materials incorporated into the goods.
“The service” means service of any description stated in the order.

Quotations

Quotations generated by AB Lab Mart shall be valid within 30 days of the date of the quotations, unless stated in terms or agreed otherwise by the company.
Quotations generated are bound by the Company's Terms, Conditions and Policies.

Use of Products

All products sold by the Company are strictly for professional use. AB Lab Mart expressly disclaims any and all liability on any misuse, mishandling and recommendation made because the company does not represent or provide warranty regarding the misuse, mishandling and recommendations.

All products, goods and services sold by the Company do not come with OSHA, ISO, GLP, MDA or any other certifications, unless indicated or stated otherwise.

Pricing

AB Lab Mart reserves the right to change pricing without prior notice.

The company reserves the right to increase the prices of the goods to account for any alteration in the cost of materials, parts, labour, or to account for any changes in work or delivery schedules or quantities, or to account for increases of the company's costs of any kind arising for any reason after the date of the order, made or caused by the customer.

Prices quoted in the quotations are on ex-work basis. The prices exclude delivery charges, packing, installation and insurance, unless stated otherwise in writing by the company.

Products, Goods and Services Availability

The products, goods and services on this website and online store, mylabmart.com, are an indication of what we might have and they may be unavailable at the time of order due to stock depletion, deletion or modification, without any prior notification, and we have no obligation to fulfill the said order but the order can be deemed as cancel.

Products and goods under indent schedule are estimated to be available in 6 to 12 weeks after payment confirmation. The estimated availability is subject to change due to many unforeseen circumstances. Cancellation is not allowed unless written approval is issued by the Company. A cancellation fee of 10% from the order value or up to RM50.00 will be deducted from the order value. The credit from the cancellation can be used for the next purchase within the next 90 days.

 

Discount Voucher or Coupon

Discount voucher or coupon or code issued by AB Lab Mart is strictly valid for intended recipients. The Company is not liable for any abuse or tamper, intentional or unintentional, by other unintended or unauthorised recipients. The Company will not acknowledge or recognise discount voucher or coupon or code utilised by unauthorised recipients.

Payment (Governmental Users)


All invoices must be payable without discount of any kind in Ringgit Malaysia (RM) on the last day of the month following the date of the company's invoice.

The company reserves the right to request the customer to pay interest at a daily rate of 8% per annum on any overdue invoice, calculated from the date of the payment is due. The customer shall also reimburse the company all costs and expenses (including legal fees) incurred in the collection of any overdue amount.

If the customer fails to pay the obligated amount or value for products which come with warranty, when the date of the payment is due, the Company reserves the right to reduce the warranty period at a rate of 30 days per week, in addition to the said daily interest rate at 8% per annum.

If the customer fails to pay the obligated amount in the order, or becomes insolvent, or believes that such event may occur, then the company may terminate the supply of any goods and shall be entitled to forfeit any payment already made.
All goods that are not paid or not fully paid remain as the Company's properties. The Company may decide to confiscate the goods if the customer displays uncooperative behaviour, unwillingness to complete the payment or fails to pay the obligated amount by 90 days after the payment is due.

Payment (Non-Governmental Users)


All Proforma Invoices must be payable without discount of any kind, unless offered by the Company, in Ringgit Malaysia (RM) within fourteen (14) days from the date of Proforma Invoice, otherwise the order is considered cancel.

All goods and services in Proforma Invoice are subject to sales unless payment is confirmed. The prices in the Proforma Invoice are valid for 14 days.

All goods and services that are not paid or not fully paid remain as the Company's properties. The Company may decide to confiscate the goods if the customer displays uncooperative behaviour, unwillingness to complete the payment or fails to pay the obligated amount by 90 days after the payment is due.

Warranty, Repair, and Return


All equipment from AB Lab Mart are warranted for one year from the date of purchase, unless stated otherwise. The warranty is valid against defects in materials and workmanship resulted from the manufacturers. During the warranty period, the equipment will be repaired, at the option and expense of the company. However, this warranty is not applicable to cases of mishandling, abuse and unauthorised repair (that is, repairs conducted by agents other than AB Lab Mart or authorised agents appointed by AB Lab Mart).

Trained engineers at AB Lab Mart are being regularly trained and updated on the recent product development and technicality, by our manufacturing principals. AB Lab Mart only uses ORIGINAL parts supplied by the manufacturers.

All equipment sent for repair or service must be sterilised and packed properly. Please be informed that shipping costs are the responsibility of the customers when the equipment is returned to AB Lab Mart for repair, although it is still under warranty. AB Lab Mart will be responsible for the shipping costs when returning the similar item.

AB Lab Mart will not service equipment that has been contaminated or believed to have been contaminated by hazardous and biohazardous materials such as diseased tissues, potentially toxic samples, radiological materials and pathogens. If the product falls into this category, please contact a professional body to do the necessary before sending it to the company.

To the best knowledge and effort, AB Lab Mart makes reliable recommendations on the properties, qualities, or application of the products sold. However, AB Lab Mart expressly disclaims any and all liability on any recommendation made because the company does not represent or provide warranty regarding the recommendations.

"Apparatus", "Chemicals", "Consumables/Disposables", "Glasswares" and "Plasticwares" from AB Lab Mart do not come with warranty.

Return of Products


Goods sold are not returnable, not refundable and not exchangeable.

Cancellation of Paid Orders


Cancellation of paid order is not allowed. Shall cancellation is approved in writing by the Company, a cancellation fee of 10% from the order value or up to RM50.00 will be deducted from the order value. The credit from the cancellation can be used for the next purchase within the next 90 days.

 

Delivery


All shipments are chargeable. The fees vary by product weight. However the calculation of shipping fees are only valid and applicable to deliveries within Malaysia

AB Lab Mart delivers orders mostly by KTM courier. The company encourages the customer to register an account with KTM courier so that delivery can be made on the customer's account number. Otherwise, the company will add the delivery cost to the order. Delivery time is determined by the speed of the payment made and cleared, the despatch and delivery services from KTM.

Unless stated otherwise in writing, goods are delivered after three (3) working days from date of remittance or after the payment is confirmed to be received by the Company, if you choose to get our delivery service. Goods are usually ready for collection from our warehouse after one (1) working day from date of remittance or after payment is confirmed to be received by the Company, unless stated otherwise.

Delivery Claims


AB Lab Mart shall ensure that every order is error-free and every product is free of damage and in proper working condition, prior to packaging and delivery. Thus, it is the responsibility of the customer to inspect all goods upon receipt within three (3) working days. The company will, then, investigate for claim of short-shipment. The delivery is not insured, thereby, AB Lab Mart is not liable to any damages and lost caused by shipping company.


By placing an official order to the Company and perusing mylabmart.com, the Company's Terms, Conditions and Policies are fully accepted and agreed upon by the customer, without any dispute.


All sales transactions by AB Lab Mart are subject to the Company's Terms, Conditions and Policies, unless agreed otherwise in writing.

In the event that any terms and/or conditions stated herein conflicts with any of the terms and conditions set out in the policies of AB Lab Mart, the latest terms and conditions (as may be revised), shall prevail.
